Deposit and Final Payment:
A non-refundable deposit of $50, which is part of the total payment, is required to confirm the event date and secure the DJ's services. The remaining balance is due upon the DJ’s arrival at the event.
Reservation of Services:
Payment of the deposit guarantees the DJ's availability for the specified event date and time.
Cancellation Policy:
This contract may be canceled by either party before the event date. If the Client cancels, the deposit will be forfeited. Cancellation must be communicated in writing, either via email or certified mail.
Attendee Conduct and Pet Policy:
The Client is responsible for ensuring that all attendees treat the DJ and equipment with respect. Pets must not be allowed to roam freely near the DJ or equipment during the event. If an attendee behaves in a dangerous, threatening, or inappropriate manner, the DJ will notify the Client and provide one opportunity to correct the behavior. If the issue continues, the DJ may cease services and leave the event without notice. In such cases, the Client remains responsible for the full payment of the agreed fees.
Weather Policy:
The DJ acknowledges that the event will take place regardless of weather conditions. However, lightning is an exception due to safety concerns related to metal-framed light and speaker mounts. If lightning is present, the DJ reserves the right to cease operations for safety.
Damage and Theft Liability:
The Client is responsible for ensuring that attendees do not damage or steal the DJ's equipment. The Client agrees to cover the cost of repairs or replacement for any damage or theft that occurs during the event.
Work Area and Power Requirements:
The Client is responsible for providing the DJ with a work area of at least 10ft x 10ft, along with a live power source no farther than 100 feet from the DJ's setup.
Payment Obligations:
The Client is fully responsible for ensuring that payments are made in accordance with the terms of this contract. If legal or attorney's fees are required to collect payment, the Client agrees to reimburse the DJ for such costs.
Governing Law:
This contract is governed by the laws of the State of Texas. Any disputes unresolved between the parties will be settled in a civil court in Dallas, Texas.
Entire Agreement:
This document constitutes the entire agreement between the parties and supersedes any other agreements, whether written or verbal. No additional agreements are valid unless documented in writing and signed by both parties.
Severability:
If any part of this agreement is deemed invalid by a court, the remaining provisions will remain in full effect. A failure by either party to act on a breach of this contract does not constitute a waiver of the entire agreement or future violations.
